Terms of Service for Roosta
These Terms govern Your use of Roosta. Please read Section 4 in particular: Roosta is deliberately difficult to turn off, and it is not a dependable alarm clock for anything that matters. On Apple devices, if You intend to use the app-deletion guard, read Section 7 before You switch it on — it restricts app deletion across Your whole device, not only for Roosta.
Roosta requires a paid Subscription. There is no free tier and no free version; see Section 6.
By downloading or using the Application, You agree to these Terms. If You do not agree to them, do not use the Application.
1. Definitions
- Account means the optional Roosta account described in Section 12, created with one of the sign-in methods offered on Your platform, and used to back up Your alarms, Your wake-up records and Your settings.
- Application means Roosta, the mobile application published by NovApps ApS, in its Apple version (together with its NightMonitor extension) or its Android version, whichever You are using.
- Apple version means the Application as distributed through the Apple App Store and run on an iPhone. Android version means the Application as distributed through Google Play and run on an Android device. Where a term below applies to only one of them, it says so.
- Company ("We", "Us", "Our") means NovApps ApS, a company registered in Denmark.
- Mission means the task the Application requires You to complete before a ringing alarm will stop.
- Screen Time means Apple's Family Controls, Device Activity and Managed Settings frameworks, used by the Apple version's optional features in Section 7. These exist only on Apple devices. The Android version offers app blocking built on ordinary Android permissions instead, described in the same Section, and offers no deletion guard at all.
- Store means the Apple App Store for the Apple version and Google Play for the Android version — the shop You obtained the Application from, and the party that takes Your payment.
- Streak means the count of consecutive scheduled mornings You won, calculated on the Device from Your wake-up records each time it is shown rather than stored as a figure of its own. A morning is won by completing Your Mission within the deadline, or — if You have switched on the manual wake-up described in Section 3 — by telling the Application You are already up before the alarm reaches You.
- Subscription means the auto-renewing subscription that gives access to the Application, described in Our Subscription Terms.
- You means the individual using the Application.
2. Eligibility and Acceptance
You must be at least 13 years old to use the Application. If You are under the age of majority where You live, You may use it only with the involvement of a parent or legal guardian, who accepts these Terms on Your behalf and is responsible for the Subscription. By using the Application You confirm that You meet these requirements and that You are not barred from doing so under any applicable law.
3. What the Application Is
Roosta is a commitment device for getting out of bed. You set a wake-up time and choose a Mission. When the alarm sounds, the only way to stop it is to complete that Mission — there is no snooze button and no way to skip. The Application then keeps an honest record of the mornings You got up on, from which Your Streak is calculated.
Alongside the alarm it offers two optional evening reminders: one counting down to Your bedtime, and one on an evening when no alarm is set for the following morning. It also offers an optional manual wake-up, switched off until You turn it on, which lets You win the coming morning without running a Mission by telling the Application You are already up; You choose how long before the alarm that becomes available. Both versions offer an optional shield that blocks apps You choose during the night, built on Apple's Screen Time on one and on ordinary Android permissions on the other; the differences between them are material and are set out in Section 7. The Apple version additionally offers a restriction that stops apps being deleted while an alarm is locked. The Android version has no deletion guard, because nothing on Android lets an application prevent its own removal. Every other feature described in these Terms is present on both.
The Application runs on Your Device. It works completely without an account, and in that state the only thing that leaves it is the short, fixed list of anonymous usage statistics described in Section 2 of Our Privacy Policy — which records which setup screens were reached and how long each was on screen, and nothing whatever about who reached them. Nothing else about You goes anywhere, and We hold nothing else on Our infrastructure. An optional Account, described in Section 12, backs up Your alarms, Your wake-up records and Your settings so that a new phone can get them back; nothing from a Mission's camera or microphone is ever part of that, or of anything else. Our Privacy Policy sets out the whole picture.
The Application is a tool for building a habit. It is not a medical device, and it is not a diagnostic, therapeutic, or treatment tool of any kind. It does not diagnose, treat, or manage any sleep disorder or other condition, it does not measure or track Your sleep, and nothing in it constitutes medical advice. The exercise Missions count repetitions; they are not a fitness assessment and are not a training programme. If You have concerns about Your sleep, Your health, or Your fitness, consult a qualified healthcare professional.
4. Important Safety Terms
Do not rely on the Application as Your only alarm for anything that matters. Do not depend on it alone to wake You for work, travel, examinations, medication, childcare, or any other obligation where failing to wake would cause You harm, loss, or injury. For anything of that kind, set a second, independent alarm.
An alarm on a phone can fail to sound for many reasons outside Our control, including but not limited to: the Device being switched off, out of battery, in a state where its operating system has restricted the Application, or in Silent, Focus, or Do Not Disturb configurations that affect alarm delivery; Your having declined or later revoked the alarm permission; Your Subscription having lapsed; a change to Your Device's time zone, clock, or system settings; the Application having been deleted, offloaded, force-quit, or not yet updated; a fault in the Device's hardware or in its operating system; or a defect in the Application itself. We do not warrant that an alarm will sound at the scheduled time, or at all.
Missions requiring physical activity
Push Ups, Sit Ups and Squats ask You to exercise in front of the camera, first thing in the morning. You take part at Your own risk and are responsible for judging what is safe for You. Do not select a physical Mission if You have any injury, illness, impairment, or medical condition that makes it unwise, and consult a healthcare professional before beginning any new form of exercise if You are in any doubt. Clear the space around You, and stop immediately if You feel pain, dizziness, or discomfort. The repetition count is produced by on-device pose analysis and is an estimate; it is not a measure of Your form, and the Application cannot tell whether You are exercising safely.
Missions that get You out of the room
Picture of Sky, Touch Grass, Item Search and Make Your Bed ask You to move around, and Touch Grass in particular asks You to go outside. Newly woken people are unsteady. Put a light on, watch for stairs, and be aware of Your surroundings. Do not leave Your home if it is unsafe to do so — because of the weather, the hour, the neighbourhood, or Your own condition — and never attempt a Mission while driving, cycling, or operating machinery. If a Mission cannot be completed safely, the Application offers the arithmetic Mission instead, as described below; that is the right way out, and it is always available.
You accept that the alarm resists being stopped
This is the entire point of the Application, and You should choose Your Mission and its difficulty accordingly. You acknowledge and accept that:
- There is no snooze and no skip. A ringing alarm will continue until its Mission is completed.
- Leaving the Application while a Mission is in progress causes the alarm to sound again shortly afterwards, and force-quitting returns You to the Mission on the next launch.
- While a Mission is on screen, the Application turns up the volume the alarm is playing through — the media volume on an Apple device, the alarm volume on an Android one — and holds it there. Turning it down does not quiet the alarm and does not end the Mission: it goes back up within a second or so, for as long as the Mission is unfinished. How loud is Yours to set in Alarm settings before You go to bed, and the Application never turns the Device down — it raises a quiet phone and leaves a loud one alone. When the Mission ends the volume is put back to where it was found, unless You have moved it Yourself since, in which case Your setting stands.
- An alarm may become locked against editing, disabling or deletion for a period before it is due, so that You cannot quietly disable it the night before. The length of that window is Yours to set, and the lock can be switched off entirely — but neither can be changed while an alarm is inside its window.
- If You have switched on app blocking, apps You chose will be unavailable until the morning is claimed.
You can always end this by silencing or switching off Your Device, or by deleting the Application — unless You have turned on the deletion guard, in which case see Section 7. Set a Mission You are confident of completing when tired: choose a difficulty You can actually manage half-awake, and do not select a Mission You may be unable to perform.
The fallback
Because there is no snooze, a Mission that cannot be completed would be an alarm that cannot be turned off. The Application therefore offers the arithmetic Mission in its place when a Mission cannot run — a refused or revoked permission, missing hardware, an uninstalled speech model, a room too dark to see You in — and again after a period without progress. The alarm still stops only when a Mission is finished. This fallback is a safety mechanism and We do not warrant that it will operate in every circumstance; Section 4's first paragraph applies regardless.
5. Licence
Subject to these Terms and to an active Subscription, We grant You a personal, non-exclusive, non-transferable, revocable licence to use the Application on devices You own or control, in accordance with the terms of the Store You obtained it from. We reserve all rights not expressly granted.
You may not: copy, modify, or create derivative works of the Application; reverse-engineer, decompile, or disassemble it, except to the extent that applicable law expressly permits despite this restriction; remove or obscure any proprietary notice; rent, lease, lend, sell, or sublicense it; use it in any unlawful manner; or attempt to circumvent, disable, or interfere with the Mission requirement, the alarm mechanism, the alarm lock, the Screen Time features, or the Subscription check.
6. Subscription
Roosta is a paid application with no free tier. An active Subscription is required to use it. The Application is free to download, but nothing in it functions until You subscribe — You cannot set an alarm, run a Mission, or build a Streak without one.
The Subscription is offered on two plans, weekly and yearly, both of which renew automatically until cancelled. A free trial is offered on the yearly plan; the weekly plan has no trial. If You decline both, Roosta offers a discounted yearly plan once, which renews yearly at that lower price and carries no trial. The plans, the prices, and any trial are shown in the Application before You confirm, and that presentation governs what You are buying.
Payment is charged by the Store, which is the merchant of record: on an Apple device, to Your Apple Account, with Apple as merchant; on an Android device, to Your Google Account, with Google as merchant. We are not a party to that payment. Auto-renewal, cancellation, price changes, trials, refunds, and what happens if Your Subscription lapses are all set out in full in Our Subscription Terms, which form part of these Terms and prevail over them on any question of purchase.
To know whether a Subscription is active, the Application uses RevenueCat, a subscription-management service acting on Our behalf. It reads the Store's own signed record of what You have bought — the App Store's on an Apple device, Google Play's on an Android one; it is not a second payment system and never sees Your card details. Section 10 of Our Privacy Policy sets out what it receives.
In short: cancel at any time, at least 24 hours before the current period ends — in Your Apple Account settings on an Apple device, or under Payments and subscriptions in the Google Play app on an Android one. Deleting the Application does not cancel Your Subscription. We do not process payments and cannot issue refunds ourselves. Refund requests go to whichever Store took Your money: to Apple at reportaproblem.apple.com, or to Google at Google Play’s refund page. Nothing in this Section limits Your mandatory statutory rights as a consumer, including any right of withdrawal under EU consumer law and any remedy for a digital product that does not conform to what was agreed.
7. App Blocking, and the Deletion Guard
App blocking exists on both versions and is built differently on each; the deletion guard exists on Apple devices only. Read the part that matches Your device. Everything in this Section is off unless You switch it on.
On an Apple device, two optional features use Apple's Screen Time frameworks. Both are off unless You switch them on, and both require Your Screen Time authorization, which You can withdraw at any time in the Settings application — doing so switches both features off.
App blocking at night — Apple devices
You may choose apps, categories and web domains to be shielded from Your bedtime until You are up. Two things follow, and You accept both:
- The Application cannot tell what You chose. Apple hands it opaque tokens rather than names, so it shields apps it cannot identify. This is good for Your privacy and it means We cannot help You work out what You blocked.
- It is not a guarantee. The shield depends on iOS honouring a schedule and on Screen Time authorization remaining in force. It can be lifted by withdrawing that authorization, and it may fail to apply for reasons outside Our control. Equally, We do not warrant that it will lift at any particular moment.
Do not shield anything You may need urgently. Choose what to block accordingly, and be aware that a shielded app is unavailable for the whole of the night window. Roosta does not and cannot block phone calls, emergency calls, or the emergency features built into iOS, but You are responsible for the consequences of Your own selection.
App blocking at night — Android devices
Android has no Screen Time, so the Android version does the same job with usage access and the permission to display over other apps. You choose apps from a list, and from Your bedtime until the morning is claimed the Application puts its own screen in front of them. Four things follow, and You accept all four:
- The Application can read what You chose. Unlike the Apple version, Android hands over readable package names rather than opaque tokens. Roosta keeps that list on Your Device, keeps it out of Your Account backup, and never sends it to Us — but it is readable to the Application in a way the Apple version's is not. Our Privacy Policy sets this out in full.
- It is not a lock, and We do not present it as one. You can switch it off inside the Application at any moment, or withdraw either Android permission, and the block stops. It is a door You have to choose to walk through, not one You cannot open.
- It is not instantaneous. Android provides no way to be told that an application has opened, so Roosta checks repeatedly. A blocked app will normally be on screen briefly before the block appears. We do not warrant that it will appear within any particular time, or at all.
- It runs a visible notification all night. Android requires one for anything that runs this long, and it will be in Your notification area for the whole of the night window.
Do not block anything You may need urgently. Roosta never blocks Your phone application, Android's own settings, or itself, so that You can always call for help and always switch this off. Beyond those, what You block is Your choice and Your responsibility.
The app-deletion guard — Apple devices only
While this is on, no app on Your Apple device can be deleted — not only Roosta. iOS offers no way to protect a single app, so the restriction is device-wide. This is stated on the screen where You turn it on, and You accept it by turning it on.
To remove the restriction, switch the guard off inside the Application, or withdraw Screen Time authorization in the Settings application. You accept that You are responsible for having enabled it, and that any inconvenience arising from being unable to delete an unrelated app while it is on is a consequence of using the feature as designed.
There is no equivalent on Android, and there will not be. Nothing on Android permits an application to prevent its own removal. The Android version requests no device-administrator role and no accessibility service, and You can uninstall it at any time.
8. Missions, Permissions, and Device Requirements
The Application requires either an iPhone running a recent version of iOS or a device running a recent version of Android. Several Missions need hardware or a Device permission, and are unavailable without it:
- Camera — Push Ups, Sit Ups, Squats, Item Search, Picture of Sky, Touch Grass, Make Your Bed.
- Microphone, plus an on-device speech recogniser supplied by the operating system — Reading. The recogniser is an operating-system asset rather than part of the Application. On an Apple device it is a model iOS downloads from Apple, and the Application will tell You if it is missing and offer to fetch it from Settings; on an Android device it is the recogniser the phone ships with, and where none is present the Application says so and substitutes the arithmetic Mission. It will never start a download during a ringing alarm.
- Nothing — Math, Memory, Typing, Shake, and the plain alarm with no Mission at all.
Missions are judged by on-device machine learning: image classification for the photograph Missions, body-pose analysis for the repetition Missions, speech transcription for Reading. These are estimates and they are not always right. Lighting, camera angle, accent, background noise, and the state of the room all affect them. Where a check would otherwise refuse indefinitely, the Application accepts Your answer after a number of attempts, or offers the arithmetic Mission — a check that could refuse forever would be an alarm You could never turn off.
We may add, modify, or retire individual Missions, including where a change to iOS or to Android makes one unworkable, and including where a Mission is available on one platform and not the other. Where a Mission is retired, alarms carrying it continue to function and fall back to a Mission that runs.
9. Your Own Text, and Your Own Sounds
The Reading Mission offers a small library of passages, comprising scripture and public-domain literary texts, alongside the option to supply Your own. They are included because they are short, familiar, and pleasant to read aloud at six in the morning. Their inclusion is not an endorsement of any religion, belief, or viewpoint, and nothing in them is offered by Us as religious, spiritual, moral, or other advice. If You would rather read something else, write Your own passage in Settings.
A passage You supply is Yours, and You are responsible for having the right to use whatever You paste in. It is stored on Your Device; if You have created an Account it travels with Your other settings into the backup described in Section 12, so that a new phone gets it back, and it is erased with the Account. It is never used for anything else and never shown to anybody but You.
Choosing a song to wake up to
Besides the sounds bundled with the Application, You may search a catalogue of music and pick a track. That catalogue is Apple’s: the search and the thirty-second preview that comes back are Apple’s public iTunes service, and what You get is the preview clip rather than the song. We do not own it, do not license it to You, and cannot promise that any particular track is in the catalogue, stays in it, or keeps working — a preview can be withdrawn or moved by Apple or by the rights-holder at any time, and none of that is within Our control. Your use of that service is subject to Apple’s own terms.
The preview is downloaded to Your Device so that it can ring an alarm without a network. It is for use as an alarm sound inside the Application and for nothing else: You may not extract it, copy it out, redistribute it, or use it anywhere other than in Roosta on Your own Device.
Importing a sound of Your own
You may instead import an audio file from Your Device. It is copied into the Application’s own storage, stays on Your Device, and is never sent to Us — the same position as a passage You wrote. You are responsible for having the right to use whatever You import, and You must not import anything You are not entitled to use.
If a chosen sound is missing when an alarm rings — the file was never fetched, the Device was restored from a backup that did not carry it, or You deleted it — the alarm rings with the Application’s own sound rather than not ringing. That substitution is deliberate: an alarm with a missing sound is still an alarm.
10. Streaks and Records
Your Streak and Your wake-up history are a record kept for Your benefit. They have no monetary value, are not property, are not transferable, and cannot be exchanged, redeemed, or sold. They live on Your Device and, if You have created an Account, in the backup described in Section 12 — and nowhere else.
A morning claimed through the manual wake-up counts in full and is recorded as having run no Mission, so Your history distinguishes the two. Like every other morning it is decided once and never rewritten, which is why the claim closes the day: the alarm does not then ring, and the morning cannot be claimed twice.
Records are computed from the times at which the Application observed events on Your Device, using Your Device's clock and time zone. A morning is decided exactly once, against the deadline in force at the time, and is never rewritten afterwards — which is what makes the number mean anything. Changing the clock or time zone, restoring from a backup, or a defect may affect what is recorded. We make no guarantee that a Streak is complete or accurate, and We cannot restore, correct, adjust, or reinstate one.
A Streak survives a small number of missed mornings each week — two, worked out from Your own records rather than chosen in advance, and reset weekly. That allowance, the mascot's tiers, and any similar in-app recognition work the same way as the Streak itself: they are presentational, they carry no value, they may change or be withdrawn in a later version, and We owe no obligation in respect of them.
11. Acceptable Use
The Application is for Your own personal, non-commercial use. Do not use it to harass, coerce or restrict another person, do not install it on a device belonging to somebody else in order to control their phone, and do not use the Screen Time features on any device You do not own or control. Do not use the Application in any way that breaks the law where You are.
12. Your Data, Your Device, and Your Optional Account
Without an Account, deleting the Application permanently deletes Your alarms, history, and settings. There is no copy anywhere else, so We can restore nothing — not on request, not as a goodwill gesture, not at all. Deleting the Application does not cancel Your Subscription.
The Application works completely without an Account, and that is its default state. Everything You create lives in the Application's own storage on the Device, and if that is where You leave it, the paragraph above is the whole of the position: a lost, stolen, damaged, wiped or reset Device takes it with it. Keeping Your Device backups enabled is one answer; such a backup is managed by Apple and Your Apple Account, or by Google and Your Google Account, as described in Our Privacy Policy.
Creating an Account
The other answer is an Account, which is optional, free, and offered in three places: on the very first screen, for somebody who already has one and wants the alarms and the history from their last phone back; once again at the end of setup; and thereafter from Settings. How You create one depends on Your platform. On an Apple device You use Sign in with Apple or Sign in with Google, and there is no password to choose and no email address to type: the provider You pick confirms who You are and tells Us only what it is configured to tell Us. On an Android device You use Sign in with Google or a sign-in code sent to Your email address; the code route means We hold the address You gave Us, and there is still no password to choose. What each route tells Us is described in Section 4 of Our Privacy Policy. Your use of Apple's or Google's sign-in is governed by their own terms, which We do not control.
An Account is personal to You and is not to be shared. You are responsible for keeping control of whatever stands behind it — the Apple account, the Google account, or the email inbox the sign-in code is sent to — because whoever can sign in with that can reach Your Roosta data. You may hold one Account at a time and must not create one on behalf of somebody else.
What an Account does, and what it does not do
While You are signed in, the Application copies Your alarms, Your wake-up records, Your settings and the names of any custom alarm sounds to Our database so that a new or reset Device can get them back. The sounds themselves are not copied — not the previews and not the files You imported — so a restored Device fetches a preview again by itself and can tell You which imported file it no longer has. Signing in on a Device that is already in use adds what is missing and overwrites nothing: the mornings You actually lived through on that phone are never replaced by an older copy.
Several things are deliberately outside it. Nothing produced by a Mission's camera or microphone is uploaded, ever — there is nothing to upload, because none of it is kept (Section 3 of Our Privacy Policy). On the Apple version, the list of apps You chose to shield is not uploaded, and cannot be: Screen Time gives the Application opaque tokens it cannot read. And Your Subscription is not held in Your Account at all; it belongs to the Store account that bought it — Your Apple Account or Your Google Account — and is restored through that Store.
An Account is a backup, not a guarantee. It is offered as a convenience and provided as-is, without any promise of availability or of a particular retention period, and Section 15 applies to it. It is not a substitute for Your Device backups, and We do not undertake to be able to recover data for You.
Deleting Your Account
You may sign out at any time, which leaves the Device exactly as it is and stops the backup. You may also delete Your Account outright from Settings, which erases the Account and everything stored against it — Your alarms, Your records and Your settings — permanently and without a copy retained. That is irreversible, it does not remove anything from the Device itself, and it does not cancel Your Subscription.
13. Intellectual Property
The Application, including its source code, design, artwork, mascot, alarm sounds, name, and logo, is owned by NovApps ApS and protected by copyright, trade mark, and other laws. These Terms grant You a licence to use the Application; they transfer no ownership. The reading passages bundled with the Application are in the public domain or used under an equivalent permission, and no claim of ownership is made over them. Music You reach through the sound picker is not Ours either: the previews come from Apple’s catalogue and belong to their rights-holders, and nothing in these Terms grants You any right in them beyond using a preview as an alarm sound inside the Application (Section 9).
14. Feedback
If You send Us suggestions, ideas, or other feedback, We may use it without restriction, obligation, or compensation to You. We will not treat feedback as confidential. This does not give Us any right to Your personal information beyond what Our Privacy Policy describes.
15. Disclaimer of Warranties
The Application is provided "as is" and "as available", without warranties of any kind. To the maximum extent permitted by law, We disclaim all warranties, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Without limiting the foregoing, We do not warrant that:
- An alarm will sound at its scheduled time, or at all;
- A Mission will correctly recognise a photograph, a repetition, or spoken words, or will do so in any particular conditions;
- The app blocking shield will be applied, or lifted, at any particular time;
- The Application will be uninterrupted, error-free, or free of defects;
- Your records or Streak will be accurate, complete, or preserved;
- The Application will meet Your particular requirements or produce any particular result;
- Defects will be corrected within any particular timeframe.
Some jurisdictions do not allow the exclusion of implied warranties, so some of the above may not apply to You. Nothing here affects the statutory rights of consumers, including the right to a remedy where a digital product does not conform to what was agreed.
16. Limitation of Liability
To the fullest extent permitted by law, NovApps ApS shall not be liable for:
- Any consequence of an alarm failing to sound, sounding late, or being missed — including missed work, travel, appointments, examinations, or obligations, and any loss that follows from them;
- Any injury or harm arising from a Mission requiring physical activity, from moving about while drowsy, or from going outside to complete a Mission;
- Any consequence of an app, category or web domain being shielded, or of the shield failing to apply or failing to lift;
- Any consequence of the app-deletion guard restricting deletion across Your Device, having been switched on by You;
- Loss or corruption of Your alarms, records, Streak, or settings, from any cause;
- Any consequence of the Application being difficult to stop, having been used as designed;
- Indirect, incidental, special, consequential, or punitive damages, or loss of profits, revenue, or opportunity.
Our total aggregate liability arising out of or relating to the Application shall not exceed the greater of the amount You paid Us for it in the twelve (12) months preceding the claim, or EUR 50.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by Our negligence, for fraud or fraudulent misrepresentation, or for gross negligence or intentional misconduct. If You are a consumer, nothing in these Terms affects Your mandatory rights under the consumer protection law of Your country of residence.
17. Indemnification
To the extent permitted by applicable law, You agree to indemnify and hold harmless NovApps ApS from third-party claims, damages, or expenses arising from Your misuse of the Application, Your breach of these Terms, or Your violation of applicable law or third-party rights. This does not apply to the extent a claim results from Our own breach, negligence, or wilful misconduct, and it applies to consumers only so far as the consumer protection law of Your country of residence permits.
18. Termination
You may end this agreement at any time by cancelling Your Subscription and deleting the Application from Your Device. Please read Sections 6, 7 and 12 before You do: cancelling and deleting are separate acts, the deletion guard may need switching off first, and deletion is permanent for Your records.
We may terminate or suspend Your licence if You materially breach these Terms. Where We do, We will refund the unused portion of a current Subscription period unless the breach was such that a refund would be unreasonable, and nothing in this Section affects Your statutory rights.
Survival. Any provision that by its nature should survive termination does so, including Sections 10 and 13 through 17, and Sections 20 and 22.
19. Changes, Updates, and Availability
We may modify the Application, its features, its pricing, or these Terms. For material changes We will give reasonable notice in the Application or on this page, and revise the effective date above. Where a change to these Terms or to Our Privacy Policy is material, the Application will say so on screen the next time You open it, summarise what changed, link to the full document, and ask You to accept it before You carry on; the date and the version You accepted are recorded against Your Device and, if You have an Account, against that Account. Continued use after a change takes effect constitutes acceptance; if You do not agree, stop using the Application and cancel Your Subscription. A change to the price of a Subscription You already hold is governed by Section 4 of Our Subscription Terms and by the rules of the Store that holds it — Apple's or Google's — each of which requires Your consent in the cases they specify.
We may designate a minimum supported version and require an update to continue using the Application, including for security, compatibility, or legal reasons. We do not guarantee that the Application will remain available, and may discontinue it. Where the Application is withdrawn, We will use reasonable efforts to give advance notice, and Section 8 of Our Subscription Terms describes what happens to a Subscription in that event.
20. Governing Law and Disputes
Please write to Us first at roosta@novapps.dev; most things are resolved that way. If a dispute is not resolved informally within 30 days:
- EU/EEA consumers: the dispute falls under the exclusive jurisdiction of the competent courts of Your country of residence, applying that country's mandatory consumer protection law.
- Everyone else: the courts of Denmark have exclusive jurisdiction, save that either party may seek injunctive relief in any court of competent jurisdiction. Any proceedings will be conducted on an individual basis and not as a class, consolidated, or representative action.
These Terms are governed by the laws of Denmark, without regard to conflict-of-law rules and excluding the United Nations Convention on Contracts for the International Sale of Goods. If You are a consumer in the EU/EEA, this choice of law does not deprive You of the protection of mandatory provisions of the law of Your country of residence.
The European Commission provides an online dispute resolution platform for consumers at ec.europa.eu/consumers/odr. We are not obliged to, and do not, participate in proceedings before a consumer arbitration board, but We will always try to resolve matters with You directly.
21. Store Terms
The Application is distributed through the Apple App Store and through Google Play. Which of the following applies to You depends on where You got it.
If You obtained the Application from the Apple App Store
The following additional terms apply, and Apple requires them:
- These Terms are between You and NovApps ApS only, and not with Apple Inc.
- Apple is not responsible for the Application or its content.
- Apple has no obligation to provide maintenance or support for the Application. Support requests go to roosta@novapps.dev.
- To the extent permitted by law, Apple has no warranty obligation with respect to the Application; if it fails to conform to any applicable warranty, You may notify Apple, and Apple may refund the purchase price. Apple has no other warranty obligation whatsoever.
- Apple is not responsible for addressing any claim by You or a third party relating to the Application, including product liability claims, claims that it fails to conform to a legal or regulatory requirement, and claims under consumer protection or similar legislation.
- Apple is not responsible for the investigation, defence, settlement, or discharge of any third-party claim that the Application infringes intellectual property rights.
- You represent that You are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that You are not on any U.S. Government list of prohibited or restricted parties.
- You must comply with applicable third-party terms of agreement when using the Application.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against You.
If You obtained the Application from Google Play
Google does not impose a comparable set of required clauses, but the equivalent points hold and are stated here so that Your position is the same whichever version You use:
- These Terms are between You and NovApps ApS only, and not with Google LLC.
- Google is not responsible for the Application or its content, and has no obligation to provide maintenance or support for it. Support requests go to roosta@novapps.dev.
- Google is not responsible for addressing any claim by You or a third party relating to the Application.
- Your use of Google Play is additionally governed by the Google Play Terms of Service, which We do not control.
- Payment, refunds and cancellation are handled by Google as merchant of record, as set out in Section 6 and in Our Subscription Terms.
22. Miscellaneous
- Severability: if a provision is held unlawful or unenforceable, the rest remains in full force.
- Waiver: Our failure to enforce a provision is not a waiver of it or of any other.
- Assignment: You may not assign Your rights under these Terms. We may assign them without restriction.
- Force majeure: We are not liable for a failure or delay caused by circumstances beyond Our reasonable control.
- Notices: You consent to receive notices from Us electronically, in the Application or by email. You may write to Us at roosta@novapps.dev.
- Entire agreement: these Terms, the Subscription Terms, and the Privacy Policy are the entire agreement between You and NovApps ApS regarding the Application.
